First here's two shots that I took this morning.

Originals at the bottom.
These were shot at ISO 200, the portrait was shot in portrait mode at 1/500 F5.6 and the windsurfer at 1/800 F6.3 in Standard mode. The are both taken with 70-200L IS 2.8. Looking at both shots, they seem a little soft, maybe shake but at those speeds, I'm not so sure, I'm hoping that there isn't the same problem that 1D MkIII had.
I took a look at a couple of shots from my 30D and 1Ds MkII with simlar settings and seem a little sharper, so I don't think shake is a problem, but I need to do some more testing because I conclude any soft focusing problems.
The body and build seem fine, sound of the shutter is a lot softer than that of the 30D, for sure it's more in line with the 400D. Overall good camera build.
BUT! with liveview enabled and activated by the SET button, since I got the camera last night, I have hit the set twice in error and turned on liveview, where as before if I hit the set button in error, simply pressing the half sutter cancels any screen pop-up (profile options in the case of my 30D). But on the 40D you have to press the SET again to cancel liveview. I may have to be a little lighter on the thumb with the wheel in future.
I'm so uphappy that I'm selling the 40D and going to the Nikon D300 tomorrow, not happy at all.... Just kidding, I love Canon, but I do want to do some more tests before I'm sure that it's a great camera, right now it's just a good camera.
