I have a friend that grows a spectacular garden of Rhododendrons and Azaleas and other plants, and every spring at bloom time, he invites the public into his garden...all free. Of course, many photographers come to capture the beauty of his garden.

He just became aware that some photographers are 'capitalizing' (his words) by offering photos of his garden for sale on their website. I explained what I could to him about copyrights to photos, but he was wondering if there was any way to have his approval of photos offered.

It does seem he has a dilemma there....since he allows picture-taking he cannot also have approval can he?

I realize this is a question from the 'other side of the fence' rather than a question for photographers....but just wondered if anyone had any suggestions for him here, other than not allowing photos to be taken.

Or might anyone have a suggestion as to where he could research this problem of his rights?
