Does the owner have to comply because he's exploiting Chelsea's publicity rights, or, since the photo was taken in his establishment, does he have the right to display the photo as long as it can't be interpeted that she is endorsing his restaurant?

In other words, could it be argued that the photo is a 'work of art' and not infringing on Chelsea's right to publicity?
